Terms of Service

The agreement between you and Berforia, LLC for using BERF_thread. Written in plain language; the spirit matters more than the letter.

The deal

By creating an account or using BERF_thread (the “Service”), you agree to these terms. If you don’t agree, please don’t use the Service.

Your account

• You must be at least 13 years old (and in some places older — check your local age of digital consent).
• Provide accurate information when you sign up.
• You are responsible for activity under your account — keep your password to yourself.
• Tell us promptly at [email protected] if you suspect unauthorized access.

Your content

• Anything you put into BERF_thread — contacts, notes, photos, check-ins, messages — is yours.
• You grant Berforia a limited, non-exclusive license to store, display, and process your content solely to provide the Service to you and the people you’ve paired with.
• The license ends when you delete the content or close your account.
• You confirm you have the right to share any contact information or content you upload about other people.

Acceptable use

Please don’t:

• Use BERF_thread to harass, threaten, stalk, or harm anyone.
• Use it to send spam, mass-unsolicited messages, or commercial solicitation.
• Upload illegal content, malware, or content that infringes someone else’s rights.
• Scrape, reverse-engineer, decompile, or attempt to extract our source or models.
• Circumvent security or rate limits, or impersonate another person.
• Use the Service to violate any applicable law.

We may suspend or terminate accounts that breach this section.

Subscriptions and billing

• The core of BERF_thread is free.
• Optional paid tiers (“BERF+” and similar) unlock additional features and are billed in advance per the price shown at signup.
• Subscriptions renew automatically until you cancel. You can cancel anytime in Settings or via the platform store that processed the purchase.
• Refunds are handled case-by-case — email [email protected]. App-store purchases are subject to Apple’s or Google’s refund policies.
• Prices may change with reasonable notice before your next renewal.

Intellectual property

• BERF_thread, TheBERF_Method, BERForithm, and the BERF_ family of marks are proprietary to Berforia, LLC.
• You may not use our names or logos in a way that suggests endorsement or partnership without written permission.
• Feedback you send us about the Service is appreciated and may be used freely without compensation.

Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, update features, or change the Service over time. Material changes that reduce functionality you rely on will be announced when reasonably possible.

Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or perfectly secure.

Limitation of liability

To the maximum extent permitted by law, Berforia, LLC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow these limits; if you live in such a jurisdiction, this section applies to the maximum extent permitted there.

Indemnification

You agree to indemnify and hold Berforia, LLC harmless from claims arising out of (a) your use of the Service in violation of these terms, (b) content you upload that infringes someone else’s rights, or (c) your violation of applicable law.

Termination

• You can close your account at any time in Settings, or by emailing [email protected].
• We may suspend or terminate your account for material breach of these terms, fraudulent activity, or if we reasonably believe continued service would harm you or others.
• Sections that by their nature should survive termination (intellectual property, disclaimer, limitation of liability, indemnification, governing law) will survive.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction. Nothing here limits your statutory rights as a consumer in your home jurisdiction.

Changes to these terms

If we make a material change, we will note it here with a new “Last updated” date and, where appropriate, surface a notice in the app the next time you sign in. Continued use of the Service after the change means you accept the updated terms.
